Texas Veteran Definition and Military Preference Eligibility

In accordance with Texas legislation (TX Gov Code, Sec 657), an individual who qualifies for a military employment preference is entitled to a preference in employment over other applicants who do not have a greater qualification for the same position

Veteran

  • An individual who served in
    • ­the US Army, Navy, Air Force, Marine Corps, Coast Guard, or the US Public Health Service under Title 42, United States Code, Section 201; or
    • ­the Texas military forces as defined by Section 437.001; or
    • an auxiliary service of one of those branches of the armed forces.
  • Has been honorably discharged from the branch of the service in which the person served.

Veteran/Military Spouse

  • A person who is the spouse of a veteran who was killed while on active duty and has not remarried; or
  • The spouse of a member of the United States armed forces or Texas National Guard serving on active duty; or
  • The spouse of a veteran if the spouse is the primary source of income for the household and the veteran has a total disability rating based either on having a service-connected disability with a disability rating of at least 70 percent or on individual unemployability. 

Orphan of a Veteran

  • A person who is the child of a veteran who was killed while on active duty.
